General Terms of Business ZERMATTERS

1. Terms of business Ski- & Snowboardschule Zermatt for the online sales of ski and snowboard lessons

General

If not expressly agreed to the contrary, the terms of business apply to all sales between the Ski- & Snowboardschule Zermatt and the customer. The object of this company is the operation of a snow sports school. This especially includes services as providing lessons to achieve skills and knowledge in skiing and snowboarding, as well as guiding. Nevertheless, we do not guarantee a certain success.

Our prices may vary during the season. High season prices are valid during the following weeks:

11.02.2018 - 23.02.2018
25.03.2018 - 06.04.2018

Contract group tuition

The Ski- & Snowboardschule Zermatt is committed to guarantee the offer purchased by the client. The offer has to be used according to the agreed date and time. It is not possible to move dates. If the client cancels the purchased item within 10 days of booking, we refund the price under deduction of a handling fee of CHF 10.

Contract private tuition

The Ski- & Snowboardschule Zermatt is committed to guarantee the offer purchased by the client. Bookings which were made and paid online are considered confirmed reservations. An online booking can only be cancelled 48 hours latest before the lesson in the ski school office (per phone +41 27 966 24 66, e-mail or personally). If this deadline is not met, we will charge the full fee as per booking.

Prices

All our prices are in Swiss Francs, our services are not subject to value added tax.

Liability

The Ski- & Snowboard School Zermatt does not accept any responsibility for accidents or their consequences occurring during instruction. Insurance is matter of the participant.

The place of jurisdiction

Place of jurisdiction for decisions of all disputes resulting from this contract is exclusively Zermatt.

Applicable law

Swiss civil law is applicable exclusively.

3. General Terms and Conditions for all ZERMATTERS Mountain Guides' Services (UIAGM)

General Provisions

Zermatters is a mountain guide agency. For tours booked with us we place visitors in contact with mountain guides, trainee mountain guides, hiking guides (the term “mountain guide” shall hereinafter refer to all 3 designations). The tour is conducted in the name of and on account of the mountain guide. The mountain guide is responsible for the implementation of the tour. The visitor shall directly notify the mountain guide of any complaints concerning the tour. Zermatters will only accept complaints concerning defects in the placement of guides.

Booking

Bookings should be made as early as possible. 1- and 2-day tours can be booked at short notice, i. e. no less than one day in advance. However, there is no guarantee that you will be able to participate in a given tour if you book at short notice.

Tours lasting several days (3 days or more) and involving large groups must be booked at least 2 weeks in advance.

Prices and Services

Prices include the guide fees and placement fees for one person. Group prices shall only apply to groups consisting of the minimum number of participants or more, as specified. Costs of transport, accommodation, meals, etc. for visitors and mountain guides shall be borne by the visitor, and should be paid to the mountain guide directly. Payment must always be made prior to commencement of the tour. No booking will be held without down payment/booking guarantee.

Insurance

Visitors must arrange their own insurance. All visitors must have health and accident insurance, as well as repatriation insurance. Taking out cancellation insurance is recommended.

Cancellation of tours, abandonment of tours en route and changes in tours

You may cancel a booked tour at no charge up to 7 days prior to commencement of the tour in the case of the day tours listed above. If you cancel the tour up to 48 hours prior to the commencement of the tour, 50% of the fee will be charged. If you cancel the tour at a later point in time, 100% of the fee will be charged.

For two-day-tours a down payment of CHF 100.–  is due in advance. For the Matterhorn a down payment of CHF 150.– is due (for the hut and the Zermatters). This amount is non-refundable. If the tour is postponed to a date later in the season, it will be credited to the client.

For tours lasting several days (3 days or more), a deposit of 50% of the total amount is due. If the tour is cancelled due to any reason (if the conditions mentioned above are fulfilled), a service fee of CHF 100.– will be retained.

Zermatters shall decide whether to cancel a tour due to an insufficient number of participants or unfavourable weather conditions.

It shall be up to the mountain guide to decide whether to cancel the tour due to unfavourable weather conditions. If a tour is cancelled by Zermatters, the visitor will not be charged.

Only the mountain guide may decide to abandon a tour en route or change a tour. In the case of a tour being abandoned en route, the fee for the visitor will be determined by the length of the actual tour that took place. If a tour needs to be abandoned en route due to lack of physical fitness or technical capabilities of the visitor, there will be no reimbursement.

If a tour is not conducted due to inclement weather conditions, the visitor shall reimburse the mountain guide the cost of accommodation in a mountain hut. In the case of changes in tours, any additional expenses shall be the participant’s responsibility. In the case of an accident or sickness of the guide (or in case of force majeure), Zermatters will try it’s best to find a replacement, though without any guarantee.

Liability

The mountain guide cannot provide any cast-iron protection against the risks objectively present in the mountains. The visitor accepts the natural residual risk of outdoor activity which remains in spite of diligent and prudent guiding. The visitor undertakes to comply with the mountain guide’s instructions. The visitor should be physically fit and technically prepared for the tour.

Place of jurisdiction

In the case of any disputes, Swiss courts shall have exclusive jurisdiction. The place of jurisdiction shall be Visp in the Canton of Valais.
